英国《金融时报》17号报导,中共当局开始请求西方民主国家政府协助缉拿外逃的官员。在代号〝猎狐2014〞的行动中,中共中纪委成立了一个专职行动组,调查已经外逃,或把亲属和资产送往海外 的,涉嫌腐败的官员。但这项请求给西方民主国家带来了巨大的挑战。为什么会这样呢,请看报导。
《金融时报》17号说,去年底落马、现已被刑事拘留的广州原副市长曹监燎,是〝猎狐行动〞在新西兰的主要目标之一。曹监燎的妻子、情妇 和至少一个同伙,是中纪委调查的对像。尽管这些人,加上曹监燎的子女,都居住在新西兰,而且其中至少有一人是新西兰公民。
北京方面已经要求新西兰政府提供这些人在新西兰的资产信息,并要求在新西兰与这些人会面。
但报导说,这个案件和其他几百宗类似案件,给新西兰和英国等自由民主国家带来了巨大的挑战。
而美国、加拿大和澳大利亚等驻华外交官也表示,他们正受到来自中共官方越来越大的压力,要求协助〝猎狐〞行动。
不过,报导说,中纪委的不透明性质,和模糊的法律 地位,使西方民主国家难以配合。就算中纪委把案件移交给中共的司法体系,司法独立性也受到严重质疑,因为法院要听命于中共权力架构。
旅美中国社会问题 研究人士张健:〝中纪委推出的这个‘猎狐行动’,根本就无法实现。中纪委并非是中国 的一个执法机构,它也不是中国的法院。如果向所有的海外国家来抓捕在中国的这些刑事犯罪的犯罪嫌疑人的话,首先第一点、所有的国家有引渡条约,第二、必须由国际刑警发布通缉令,才有可能达到这样一个效果。中纪委根本就不是这样一个机构。〞
据了解,中共至今只与周边38个国家签订了引渡协议,但与任何一个西方民主国家,都没有签署引渡条约。
时事评论员任百鸣:〝包括美国、加拿大,因为中共的人权恶劣的记录吧,都跟中国没有引渡的协议,所以实际操作起来,所谓在海外抓捕这种贪污腐败份子,这个是相当困难的,不符合法律程序。更何况中纪委也不是中国正式对外的司法渠道,所以操作起来就更困难。所以西方国家,民主治国,一般来讲,对这方面是没有办法进行配合的。〞
时事评论员任百鸣认为,当局的〝猎狐行动〞,只是在造势的层面上运作。
任百鸣:〝习近平搞这个反腐,在国内就是搞的轰轰烈烈的,势必他的阵营还想把这一波势头向海外延伸。中共的宣传方面也比较喜欢出口转内销,它通过对海外的所谓‘猎狐行动’,对国内的老百姓而言,它可以找一些设定好的典型案例,大肆进行宣传,也增强对习近平的民意吧,也为习近平下一步向纵深发展,最后打到江泽民头上,也是取得一定的民意基础。〞
旅美中国社会问题研究人士张健认为,中共的〝猎狐行动〞有不良的用意。
张健:〝它用这一招,把所有在海外贪官不能被抓捕回国的原因,推给这些西方民主国家。民主国家依照法律办事,中共非常清楚。‘猎狐行动’在国外是完全无法实施的,但是它不会告诉国内老百姓,这样让老百姓误以为,西方民主国家是中国贪官污吏的一个天堂,西方民主国家贪图中共的钱财。〞
非政府组织〝透明国际〞负责东亚事务的廖燃向《自由亚洲电台》表示,中纪委书记王岐山讲,以〝治标〞为反腐赢得时间。而〝治标〞就是抓人,这种寒蝉效应,导致更多贪官集中外逃,现在,中共当局就必须把贪官外逃的路堵死。

Communist Regime Seeks A Difficult Help from The West
Financial Times reported on Tuesday,"Beijing seeks to enlist
the help of western democratic governments in pursuing officials
who flee overseas."
"In an operation labelled"Fox Hunt 2014", the party's Central
Commission for Discipline Inspection… has set up a dedicated
office to investigate allegedly corrupt officials who have absconded
or sent relatives and assets abroad."
But this request seems very difficult for any western democracy
to co-operate with.

The Financial Times reported,"That the wife, mistress and
at least one associate of Cao Jianliao, detained former
vice-mayor of the megalopolis Guangzhou, are the subjects
of a CCDI investigation.”
"This is despite all of them, as well as Mr Cao's child,
being based in New Zealand and at least one of them being
a New Zealand citizen.”
"Communist party officials have already launched an
investigation into assets and individuals based in New Zealand."
"Investigators have requested permission to interview people
in the country,"added FT.
FT Chinese also mentioned this request is difficult for
western countries to comply with.
FT said,"Beijing-based British, US, Canadian and Australian
diplomats say they are all under increasing pressure to assist
with the Fox Hunt campaign.”
"The opaque nature of the CCDI and its ambiguous legal status
make it very difficult for any western democracy to co-operate."
Even if the case is transferred to the judicial system,
judicial independence is seriously questioned,
for the court must take orders from the regime power structure.
China’s social problems researcher Zhang Jian: “The CCDI's
Fox Hunt simply can not be achieved.
The CCDI is not a law enforcement agency or a Chinese court.
Arrest of these criminal suspects from overseas needs at first
an extradition treaty, and an arrest warrant issued by Interpol.
But, CCDI is simply not such an institution.”
The Communist regime has only signed extradition agreements
with 38 neighboring countries, and none of the western
democratic countries.
Commentator Ren Baiming: “Countries such as the United States
and Canada, have no extradition agreement with China
due to the poor human rights record of the CCP.
The actual operation of the arrest overseas is very difficult
and does not meet the legal process.
The CCDI is not the official foreign judicial channel.
The operation is even more difficult.
In general, there is no way for the western countries,
democratic governance, to co-operate.”
Ren Baiming believes the Fox Hunt is just a work on
'campaign' level.
Ren Baiming: “Xi Jinping's anti-corruption is vigorous in the
mainland.
His camp intends to extend this wave of momentum
to overseas.
On the publicity, CCP also prefers to 'import' its export.
This overseas Foxfire would be great publicity for Xi Jinping
through certain planned and typical cases.
Further development of the strategy will set public opinion
and allow Xi Jinping to tackle Jiang Zemin.”
Zhang Jian believes the Foxfire harbors some ill-intentions
of the CCP.
Zhang Jian: “This move will allow the CCP to blame the West
for the reasons why these corrupt officials remain overseas.
CCP is fully aware of how the West would act based on law.
The Foxfire has no way out in foreign countries.
But, it won't tell the Chinese but only mislead people
that the West is a haven for corrupt Chinese officials,
and the West covets the wealth from China.”
The NGO Transparency International for East Asian Affairs
Liao Ran told Radio Free Asia, the secretary of CCDI, Wang Qishan,
had spoken of the strategy 'cure the symptoms' to gain time
for the anti-graft campaign.
That means to arrest the corrupt officials. This chilling effect
will only cause more escapees overseas.
The CCP must block the flight path of the corrupt officials.
