【禁闻】港媒:中共近期将全面废除劳教

2013年11月04日讯】目前正是召开中共十八届三中全会前夕的敏感时刻,中南海高层 的博弈日趋激烈与白热化,各自通过外界传媒释放信号。最近有媒体报导,中共将于近期全面废除已经实行了56年的。下面请看报导。


香港《明报》11月3号报导,有独立的消息来源证实,大陆 当局将于近期全面废除劳教制度。报导说,促成官方改变劳教制度的原因有两个:第一,外界对劳教制度〝不经法律 程序剥夺 人身自由〞的批评不绝于耳;第二,今年部分地区停用劳教后,当局的〝维稳〞压力并未明显增加。


南京东南大学法学院教授张赞宁:〝我想主要是这个劳教制度确实是声名狼藉,大家都觉得它是恶果累累、罪恶累累。〞


《明报》还提到,北京倾向于用一个讨论多年的所谓《违法行为矫治法》,来代替劳教制度。


中国 宪政学者陈永苗:〝维稳政策出来之后,它已经有各种各样的维稳工具,就不需要劳教制度了。所以它就顺水推舟:你不是要求废除掉劳教吗,我就废除。但是实际上各种替代性的东西实际上是更多的。〞


大陆维权 人士也向《新唐人》表示,即使当局果真废除劳教制度,也是换汤不换药,对访民和普通民众没有任何意义。


大陆维权人士天理:〝现在劳教制度没有了,立刻用那个‘扰乱社会公共秩序罪’逮捕、关押,关你几个月再放你。它就是这种心态。〞


北京维权人士李学会很早以前就曾要求当局废除劳教制度。他谈到,现在北京有很多访民被关进〝黑监狱〞迫害。


北京维权人士李学会:〝我们的社会是建立在谎言的泡沫上。这一次能不能做出一点(改变),也(是)考量执政者的一个度。〞


中共劳教制度始于上世纪50年代,被用来对付当时所谓的〝〞知识份子。 1999年江泽民开始之后,劳教所成为中共迫害法轮功 学员最主要的犯罪场所。 2000年10月,被称为人间炼狱的〝辽宁马三家劳教所〞,有18名女法轮功学员被投入男牢,惨遭轮奸,导致至少5人死亡 、7人精神失常、其他人致残。


而活体强摘法轮功学员器官的惊天罪恶更让举世震惊。这其中,劳教等政法系统 ,与军警、医院、迫害法轮功的专门机构——办公室等同流合污,所犯罪恶罄竹难书,被外界称为:〝这个星球上前所未有的邪恶。〞


去年,重庆前公安局长王立军出逃美领馆之后,重庆前市委书记薄熙来、中共前书记、前中共魁江泽民等策划的政变丑闻被曝光。而政变的核心则是江派血债帮妄图通过继续把持政法委这一〝〞,最终以薄熙来取代中共现任总书记习近平,从而延续迫害法轮功政策,避免被清算。


薄熙来垮台后,现任政法委书记在今年初表示,今年将停止劳教制度。之后各地劳教所开始悄悄清空在押人员,一部分法轮功学员被释放回家,但仍有很多法轮功学员被当局以各种名义关进〝洗脑班〞,也就是所谓的〝法制学习班〞、和〝黑监狱〞等。


今年9月29号,黑龙江省鸡西市女法轮功学员于金凤,被非法绑架到原鸡西劳教所的〝洗脑班〞迫害。 10月16号,北京律师 唐吉田陪同于金凤的丈夫,前往鸡西〝610办公室〞交涉,却被当地警方以所谓〝扰乱公共场所秩序〞为名拘留。事件被曝光后,引起社会各界极大关注,律师界更组团前往要人。迫于压力,鸡西当局将唐吉田律师释放。

Hong Kong Media: The Chinese Communist Party Will Completely Abolish the Labor Camp Policy


Right now, the Third Plenary Session of the 18th CCP

Committee is about to begin, and the political battles

among different factions are reaching their climax.


Each faction is releasing political signals favorable for itself.


Recently, Hong Kong media reported that the CCP is going

to completely abolish its 56-year old labor camp policy.

Let’s take a look.


Hong Kong’s Ming Pao reported on November 3rd

that China is going to completely abolish its labor camp policy,

based on an independent information source.


The report says that there are two causes that have led

to the abolishment of the labor camp policy.

First, the criticisms of China’s labor camp policy have never

stopped, since people’s freedom is deprived

without the normal legal procedure under this policy.


Second, with labor camps in certain areas closed,

the pressure of “stability maintenance” hasn’t escalated.


Zhang Zanning, Law School Professor from Southeastern

University: “The party’s labor camp policy is indeed

notorious, and innumerable sins have been committed

under this policy.”


The article also mentioned that Beijing’s authority tended

to utilize the “Illegal Behavior Correction Law,” which has

been under discussion for many years, to replace

the labor camp policy.


Chen Yongmiao, scholar of China’s constitutionalism:

“The party already has its ‘stability maintenance’ policy,

and it also has various tools to maintain stability. ”


Therefore, the labor camp policy is not necessary anyway.


What it’s doing is nothing but ‘pushing the boat along

with the current.’

That is, aren’t you asking for the abolishment

of the labor camp policy?

I’ll do it for you.


In actuality, it already has too many tools

to replace the labor camp policy.”


Human right activists in China also told “New Tang Dynasty

TV Station” (NTDTV) that even if the party really tries

to get rid of the labor camp policy, it’ll still be a change

in form but not in content.

It means nothing to ordinary people.


Tian Li, human rights activist from China, “If labor camps

are closed right now, the party would still arrest you

and imprison you in the name of ‘disturbing

public order.’

This is its mentality.”


Li Xuehui, human right activist in Beijing, asked

for abolishment of the labor camp policy a long time ago.

He said that a lot of petition citizens were thrown into

“black jails” and were severely persecuted.


Li Xuehui: “Our society was built upon a bubble of lies.


Whether it can make a little change this time

is a consideration of the current authorities in power.”


The party’s labor camp policy originated from the 1950s,

and was employed to persecute “the rightist” intellectuals.


Since Jiang Zemin cracked down on Falun Gong practitioners,

labor camps have become the main criminal places where

the party applied the persecution of Falun Gong practitioners.

In October 2010, in “Liao Ning Masanjia Labor Camp,”

which is also called “a hell on the earth,” 18 female

Falun Gong practitioners were put into male prisoner cells

and were brutally gang raped.

There were five fatalities, seven developed psychiatric

disorders, and the rest were maimed.


In addition, the live organ harvesting from Falun Gong

practitioners has shocked the whole world.

Labor camps, military, police, hospitals, as well

as 610 offices (the specific structures founded to persecute

Falun Gong) are partners in the crime of persecuting

Falun Gong practitioners.

The sins they’ve committed are too numerous to be listed.

It’s referred to as the “new form of evil on this planet.”


Last year, since Wang Lijun, former head of Chongqiang

police station, fled to the U.S. Consulate, the political plot

of Bo Xilai (Former Sectary of Chongqing),


Zhou Yongkang (Former Sectary of the CCP Politics

and Law Committee) and Jiang Zemin (Former party head),

were exposed.


Jiang’s faction was trying to replace Xi Jinping with Bo Xilai

by firmly controlling the Politics and Law Committee,

the party’s second power center.


After Bo’s fall, Meng Jianzhu, the current Secretary

of the Politics and Law Committee, said early this year

that the labor camp policy would be abolished

during the year.

Later on, people jailed in labor camps in various areas

were released, including some Falun Gong practitioners.

However, quite a lot of Falun Gong practitioners

were detained in “brainwashing class,” also called “law study class” or “black jails.”


On September 29, Yu Jinfeng, Falun Gong practitioner

from Jixi City, Heilongjiang province, was kidnapped

and taken to “brainwashing class” at the former

Jixi labor camp.

On October 16, Yu Jinfeng’s husband, accompanied

by lawyer Tang Jitian from Bejing, went to Jixi’s 610 office

to talk to the authorities about Yu’s being illegal arrest,

Nevertheless, even Lawyer Tang Jitian was arrested

in the name of “disturbing the public order.”


Since this event was exposed to the public, it has drawn

a lot of attention from various communities.

Lawyers from various areas even formed a team

to ask for the release of Lawyer Tiang Jitian.

Under pressure, Jixi local authorities released Tang.
